Madras High Court Upholds CB-CID Probe into Illegal Sand Transportation Case

The Madras High Court has reaffirmed its decision to proceed with a CB-CID investigation into the illegal transportation of sand during the redevelopment of the Tirunelveli Periyar Junction bus stand. This decision follows the dismissal of a review application filed by Tirunelveli Corporation, reinforcing the court’s commitment to transparency and accountability in addressing public interest concerns.

The case stemmed from a petition filed by S. Sudalai Kannu of Tirunelveli, highlighting suspicions of unlawful sand transportation under the pretext of bus stand renovation. In response to the petition, the court had previously directed a CB-CID probe, tasking experts with examining the nature of minerals excavated during the redevelopment process.

Despite Tirunelveli Corporation’s attempt to challenge the court’s decision through a review application, the Division Bench of Justices S. S. Sundar and B. Pugalendhi dismissed the appeal. The court emphasized that the power of review is limited and can only be invoked in cases where there is a clear error leading to a miscarriage of justice.

After careful consideration of the arguments and examination of the records, the court found no grounds for overturning its previous order. It underscored that review proceedings are not intended to serve as a platform for disputing the original judgment but rather ensuring adherence to legal principles and fairness in judicial proceedings.

As a result, the Madras High Court has upheld the CB-CID investigation, signaling a commitment to uphold the rule of law and address concerns regarding illegal activities. The directive reaffirms the court’s dedication to safeguarding public interest and promoting transparency in governance.
