The Indian Union Muslim League (IUML) has moved the Supreme Court, urging a stay on the implementation of the Citizenship Amendment Act (CAA), 2019, and the rules notified by the government on March 11, 2024. The IUML emphasized the government’s prior assurance that the CAA would not be implemented until rules were framed, which is why the IUML now seeks a stay as the rules have been notified.
The government, during the CAA challenge nearly five years ago, had convinced the Supreme Court that the rules were yet to be framed, preventing a stay on the act. Now, the IUML, at the forefront of the 250 petitions challenging the CAA, points out the sudden notification of rules while the case is still pending in the Supreme Court.
The IUML’s plea specifically targets the Citizenship Amendment Rules notified by the government on March 11, 2024, which outline the procedures for implementing the CAA at the ground level. These rules establish an expedited process for granting citizenship to certain illegal migrants based on their religious affiliation and country of origin.
The IUML, represented by advocates Haris Beeran and Pallavi Pratap, aims to secure a stay on the implementation of the CAA and its associated rules through this legal move. The IUML’s petition emphasizes the need for a thorough examination of the CAA’s constitutionality and its potential impact on the country.
