The European Commission has mandated adult content companies, including Pornhub, Stripchat, and XVideos, to carry out comprehensive risk assessments and implement measures to address systemic risks associated with their services. This requirement stems from the new EU online content rules outlined in the Digital Services Act (DSA).
Under the DSA, these three adult content platforms were designated as “very large online platforms” in December, necessitating stricter compliance with EU regulations. These platforms must remove illegal and harmful content more effectively and promptly.
The European Commission’s statement highlighted specific obligations for these platforms, including submitting risk assessment reports and implementing mitigation measures to address systemic risks. Additionally, these platforms must meet enhanced transparency requirements, particularly concerning advertising practices and data accessibility for researchers. Failure to comply with the DSA could result in fines of up to 6% of the company’s global annual turnover.
The designation of these adult content companies as very large online platforms underscores the EU’s commitment to regulating online content and ensuring user safety. As part of their compliance, these platforms are required to analyze the specific threats to European rights and safety posed by the content they host and submit reports to regulators.
Furthermore, the platforms must act swiftly to remove any illicit content upon awareness and report serious criminal offenses to legal authorities when identified in user-submitted content. This move aims to ensure a safer online environment and mitigate risks to European citizens.
The Digital Services Act represents a significant step in the EU’s efforts to enhance online safety and accountability for large online platforms, with strict penalties for non-compliance. The compliance measures set forth by the EU are part of a broader initiative to create a safer digital landscape across Europe.
